AGU will simplify legal analysis to facilitate investments in the country

The attorney General of the Union (AGU) has published this Friday (28/09) ordinance (no. 293/18) with a set of guidelines to the units responsible for legal advice to the public administration to give more agility to the analysis of investment projects in infrastructure of the country.“The goal is to facilitate the understanding of the regulatory frameworks, simplify the process of technical analysis and increase the transparency of the rules to give more legal certainty to entrepreneurs who want to invest in the country,” said the attorney-general of the Union, minister Grace Mendonça, who wrote the ordinance.The ordinance establishes, for example, that priority is given to the legal analysis of processes and administrative acts of the enterprises that are part of the Program of Partnership Investment (PPI).The legal teams must also conduct a manifestation joint when the analysis involves more than one body or entity of the federal government. In addition, the legal advisers with the ministries and regulatory agencies should identify ways to standardize powers and procedures in the context of the PPI and of the National Privatization Program (PND).The idea is to develop, whenever possible, opinions, edicts, administrative acts and contracts standardized, to facilitate and streamline the entire process.
